Members present:

Absent with notification: Dick Ferren, DF;

Notice of Intent, Richard Heiss, Sargent Brook Road, Map 1 Lot 2 of Parcel 35.  Continue to mow an existing 6’ wide grass path through the buffer zone and BVW to Laurel Lake; mow a 12’ by 12’ sitting area; install a boat rack, 2 pipes for attachment of removable floating dock, weed-whack parcel two times a year and remove invasive shrubs. Continued from August 21, 2008, September 4, 2008, September 18, 2008, October 2, 2008, December 18, 2008, January 15, 2009, and March 19, 2009.
Continued to April 16, 2009.  

Valley Mill NOI Lenox Valley WTF, LLC, 64-68 Willow Creek Road Map 9 Parcel Parcels 7 & 8.  Modification to the existing Lenox Transfer Station and associated site work. Present was Jim Scalise and Brett Kaminski of SK Design Group.

This is a redevelopment of an existing facility located on two lots that are abutted to the north and south by a lumberyard and consists of 1.2 acres on property adjacent to land on Woods Pond.  

Mr. Scalise presented a site map and summarized the NOI by going step by step showing its compliance with the updated storm water management directive. He also discussed the proposed floodplain modifications and possible projects to compensate to improve the riverfront area.  The DEP file number has not been received.

A site visit was scheduled for Saturday, March 21, 2009 at 8:30 am.

RFC made a motion to continue to April 2, 2009 at 8:30 pm. VA seconded the motion and the Commission voted to agree 6-0.

There were two outstanding Orders of Conditions against this property.  DL made a motion to issue Certificates of Compliance on 198-148 and 198-192, stating that the Order of Conditions on  both projects were invalid as the work regulated by the referenced Order of Conditions never commenced. VA seconded the motion and the Commission voted to agree 6-0.  

Notice of Intent, Birchwood Village Townhouse Association 30 Clifden Ct. & 15 Wexford Ct. Map 8 Parcel 6.  Remedial improvements associated with an existing storm water management system.

Michael Kulig, of Berkshire Engineering, presented a review of the project which included all items cited during the site visit of March 14, 2009.  Present at site visit were:  Mike Kulig, TF, VA, NC, and JS.

A file has not been received as of yet.  RFC made a motion to continue to April 2, 2009 at 7:00 pm and VA seconded the motion.  The Commission voted to agree 6-0.

Minutes:  TF made a motion to approve the minutes of March 2, 2009 and JS seconded the motion.  The Commission voted to approve the minutes 4-0-2 with RFC and DL abstaining as they were not at that meeting.

Site visit:  NC advised the Commission that he went to 103 West St. on March 19, 2009 at the request of the architect Mark Smith. They wish to put in a garage and wanted to make sure that they were compliance with regards to the WPA.  NC said that this area was not jurisdictional.
